A FlagStar Bank lawsuit was recently filed against one of their customers for DSS fraud. This is a victimless crime because no one was hurt or even killed in the process of this crime. The victim was overcharged for an account that the person did not open nor did they authorize. FlagStar Bank would like to have their money back, but it seems that is too heavy a burden for them to shoulder.

The bank has decided to take this situation to the courtroom and is seeking a judgment of restitution for the financial harm they have caused this customer. This is essentially an attempt to collect on a credit card debt that was never authorized.
They are asking for a court judgment to recoup what they feel is owed. The customer is basically asking for some form of retribution for stealing their money.
There were some discrepancies in billing records that the victim overlooked.
One account had overdraft fees and another did not. These were the only charges on both accounts. When confronted with these, the victim felt that he had made a clerical error and that he should not have allowed those charges to occur. He did not open the account nor did he authorize the charges.
Upon learning of these fraudulent charges, the customer called FlagStar Bank.
They told the victim that he could not open the account as it was closed due to insufficient funds. When the employee told the customer that there were no such funds available, the customer became suspicious. He looked up the closed account and discovered that it was a charge card that had a balance of zero dollars.
He then called FlagStar Bank to report the fraud.
They sent a report to the customer’s bank, which resulted in their opening a court case. The bank has already placed a judgment against the customer. This is just worse than sad and worrisome. I have been trying for well over two years from COVID to get our home refinanced and FlagStar has failed us in every way. All my calls are answered by their recording saying their volume of calls being too high and everyone who answers their phones are loan service mitigation. Last one called me three filthy names and I only answered my phone and he dared to call me three names. I have called them time after time and everyone there never answers their phone but no one knows anything but they will curse out a person who is the mortgage borrower? I am the lien holder and our loan was sold out to FlagStar from Chase Bank after me not missing one single payment in 12 years.I am scared and a disabled senior citizen that will lose my home and my worry gets worse each day. My husband and I do not want to be out in the street or living in our car but I have no idea of how to fix FlagStar. Yet they continue to send me notices telling me I owe more money and more money and more money. We are simply afraid of being kicked out into the street or living out of our car. What is the matter with FlagStar Bank and who can help keep us from losing our home. Every day I wake in fear of getting eviction papers on a home I was/am buying and paid on for 12 years. Who is protecting all the mortgage holders of FlagStar Bank and how many people will be evicted needlessly due to the sheer negligence of FlagStar? Right now I am afraid to answer our phone out of fear of being verbally abused by FlagStar personnel again.
We have no idea which direction to turn and since all the mortgage loans are insured through the federal government then why is our federal government allowing this to happen?

Flagstar denied and refuse to give a home modification of loss mitigation.
I filled st lest 5 times, there excuse was nothing or I need the document that they had in there possession.
The coborrow filed a quick claim deed that they received and they needed this quick claim deed.
They also charged me fees when I was on bankruptcy and forbearance.
Then they sold my loan in July of 2022 with 35,000 in charges.
I now can’t make a payment to the new loan place and am about to go into foreclosure.
